Structural Waterproofing Update

Hello South Hampton Owners,

“We wanted to give you an update on the letter you may have received earlier this week.  We have confirmed that the subcontractor has indeed been paid, in full, by the general contractor. Please note that this subcontractor never had a contract with the South Hampton POA.   

The general contractor is meeting with his attorney next week to answer the complaint so there is nothing South Hampton owners need to do at this time.

Structural Waterproofing Update

Hello South Hampton owners,

We wanted to give everyone an update on the letter(s) from Structural Waterproofing about South Hampton.  The General Contractor’s attorney has answered the complaint as we told you they would.  The HOA also contacted the attorney for Structural Waterproofing on behalf of the HOA, and all owners.  The South Hampton HOA and KPMA attorney have gotten an extension of time to respond to the complaint, which is now due by November 2.  The attorney for the Structural Waterproofing does not require a response from individual owners until further notice, if at all.

We followed up on these emails after we received the lawsuit papers from Structural Waterproofing sub-contractor’s attorney, Caroline Trautman with the lien on our property.  It states in the papers that owners need to respond to the lawsuit within 30 days, that is why we contacted her.

Caroline said it has not been paid as Chris Millar stated in his August 28th email and they have every right to put a lien on our properties since our properties benefitted from the work done. It doesn’t matter if we have a contract with them or not.

She said her client and her have tried to communicate with the HOA, KPMA and Tribune over the money and they were not communicating and that is why the lawsuit was filed.  

Since these emails were sent out, the contractor, sub-contractor, KPMA, HOA and also the owners all have attorneys. The sub-contractor’s attorney is Caroline Trautman, HOA attorney is Sheri McAllister and owners attorney is Charles Jordan.  Sheri McAllister is Doug Millar’s wife.

The attorney fees will be paid out of our dues according to the attorneys.  Not sure why the owners have a different attorney than our HOA.  So I guess we will be paying for the HOA and owner’s attorney if we decide that we want representation.  They both will be gathering all the same information.

When we contacted Sheri McAllister she told us she represents the HOA and Charles Jordan is representing the owners.  We contacted Charles Jordan, he said he is representing the owners and he is gathering information together and will get paper work out to the owners, that was about 3 weeks ago.  We can decide if we want him to represent us or if we want to get our own attorney or represent ourself.  This will be an individual choice.   As of a couple weeks ago, all three attorneys were not sure who has not paid the $101,000.00 and why.  We asked Charles Jordan if we decide to represent ourselves do we have the legal right to see all documents, change orders and contracts and he said, yes we do.  An owner is looking into this now.

These email from Litus, Chris Millar, are very misleading and not true according to all three attorneys.  We emailed Chris asking for an explanation and he came back with, we do not have the right information.  We asked him to clarify where the discrepancies are and he never responded.  That was 3-4 weeks ago.

When these types of emails are sent by our management company, they are approved first by our president, Don Matheson.

We have three board members with two open positions.  In our bylaws it states, we need to have a president, secretary and treasurer.  Right now Litus does the work of our secretary and an ex- board member is acting as our treasurer.  Out of the three filled positions, two jobs are being done by non-board members.  This is why numerous owners have requested we have our elections.

Our president, Don Matheson, knew about the lawsuit but the other two board members did not know anything until they received their lawsuit papers.  In September 24th 2020 email, Chris Millar says the HOA hired an attorney, two of three board members were not involved in that.  This was done by Chris Millar and Don Matheson.
