I sent the below email to you on December 20th and have not yet received a response from you or our Board President, Don Matheson. I understand a delay due to the holidays, but I should have received a response by now.
When will you be responding to this email and providing factual information to support your and the boards decisions regarding the outlined topics below?
The special assessment You, Don Matheson, and Bud Fisher are putting in place this month is in violation of the Master Deed. I suggest a quick and full transparency to the financials that are resulting in the need for the special assessment. You, Don, and Bud need to communicate the financials clearly along with any issues around this project to the homeowners and then properly seek the 51% approval for the special assessment from the homeowners as required by our Master Deed.

Thank you for your email and for sharing your opinions. The Board will review and discuss your comments this week.
In the meantime it is important to note that the special assessment vote by the Board passed unanimously and the motion for it was seconded by a Board member who is NOT one of the 3 people you listed as “putting the special assessment into place”.

What does your point of the “second” the motion have to do with any of this? You obviously are trying to bring me into this so let’s be clear. I was the board member who seconded the motion and I did so under the premise that you were talking about an assessment for the owners with shutters—not an assessment for all homeowners. And you know that.

Good morning Sheri, the Leontis decided to petition the South Hampton board to call a special meeting so that the board can provide the answers that the Leontis have requested for months, and that the board has thus far failed to answer. Attached to this email are petitions from 37 owners. We expect additional petitions to be signed. The board will note that the bylaws require as few as 10% of members to call a special meeting (or the board can call a special meeting on its own volition, which we requested, and the board declined), whereas this is over 20% of members. Obviously, members are concerned that the board has not been meeting its duty to keep the membership informed, amongst other potential violations of the Association’s governing documents. As per my initial communication, we had hoped this step would be unnecessary, but the board has steadfastly refused to provide information that members are entitled to know.
Demand is hereby made that the board calls a special meeting for the purposes set forth in the petition. Please confirm receipt on behalf of the board and on behalf of the Association’s secretary. While I hope you will accept this on behalf of your client, if your client requires that the petition be delivered to the secretary, please let me know the specific address before 3:00 p.m. today so that I can FedEx the petition for morning delivery tomorrow.
